Home Buyer Wins £150,000 Legal Victory Over Seller Who Lied About Potential Risk Of Flood Surrounding The Riverside Home

Cesar and Caroline Basanta fell in love with a riverside property and thought they had found their dream home.
They were only concerned about the stream running through the garden but were assured by the seller that the five-bedroom detached property had never flooded, they agreed to pay £470,000 then moved in. 13 months later, the riverside home turns into a water bank.
Now, following a six-year legal battle, former owners John and Norma Bradshaw face a £150,000 bill after a court ruled they should have told the Basantas when they bought the house in November 2007 that the garden had flooded in the past.
Mr Basanta, 40, a management consultant, said: ‘The fact the garden floods has ruined our lives. Had we known we never would have bought it. We live in fear every time it rains.’

But 13 months later their dream turned to a nightmare when the River Marden burst its banks, leaving the house in Calne, Wiltshire, surrounded and the garage waist-deep in floodwater (the before and after views from the family's front window)

Mr Bradshaw, a retired Army major now divorced and living in Dorchester, Dorset, told the court there had been water ‘ingress’ to the garden in 2006 – from a blocked culvert – but not a flood Mr Basanta refuted that, and won
